1. Agreement to Terms
By accessing or using the Gaffer platform ("Service"), operated by Gaffer ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Gaffer provides an AI-powered WhatsApp business assistant for tradespeople. The Service includes automated messaging, scheduling, invoicing, quote generation, and related business tools delivered via WhatsApp, SMS, and a web dashboard.
3. Eligibility
You must be at least 18 years old and operating a legitimate trade or service business to use Gaffer. By signing up, you represent that the information you provide is accurate and complete.
4. Account Registration
- You must provide a valid email address, phone number, and business details during registration.
- You are responsible for maintaining the security of your account and all activity under it.
- One Gaffer account per business. Multiple accounts for the same business are not permitted.
5. Subscriptions and Billing
- Gaffer offers Starter and Pro subscription tiers, billed monthly.
- All new accounts begin with a 7-day free trial. Your payment method will be charged at the end of the trial unless you cancel.
- Prices are displayed in GBP or USD depending on your country selection and are exclusive of VAT where applicable.
- You may cancel your subscription at any time via the billing dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
- We reserve the right to change pricing with 30 days written notice. Existing subscribers will be notified by email before any price change takes effect.
6. Phone Numbers
- Each Gaffer account is provisioned with a dedicated phone number for WhatsApp and SMS communication.
- Phone numbers are owned by Gaffer and provisioned through our telecommunications provider (Twilio).
- Phone numbers assigned to your account are not portable and cannot be transferred or ported to another provider or account. If you cancel your subscription, your assigned phone number will be released and may be reassigned.
- You must not use your Gaffer number for any unlawful, abusive, or spam purposes.
7. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages or spam
- Harass, threaten, or abuse any person
- Transmit illegal, fraudulent, or harmful content
- Impersonate another person or business
- Violate any applicable law, regulation, or third-party rights
- Attempt to reverse-engineer, extract, or interfere with the Service
We reserve the right to suspend or terminate any account that violates these terms without notice or refund.
8. AI-Generated Content
- Gaffer uses artificial intelligence to generate responses, quotes, invoices, and other communications on your behalf.
- While we strive for accuracy, AI-generated content may occasionally contain errors. You are ultimately responsible for all communications sent through your Gaffer number.
- You should review important communications (quotes, invoices, booking confirmations) and ensure their accuracy.
- Gaffer is not liable for any loss arising from AI-generated content, including incorrect pricing, scheduling conflicts, or miscommunication.
9. Customer Data
- You retain ownership of all customer data you input or that is collected through your Gaffer account.
- We process customer data solely to provide the Service. See our Privacy Policy for details.
- You are responsible for obtaining appropriate consent from your customers before their data is processed through Gaffer, in compliance with applicable data protection laws (including UK GDPR).
- You may export or delete your customer data at any time via the dashboard.
10. Invoicing and Payments
- Gaffer facilitates invoice creation and payment link generation on your behalf. Payment processing is handled by Stripe.
- Gaffer is not a party to transactions between you and your customers. We are not responsible for payment disputes, chargebacks, or non-payment.
- You are responsible for the accuracy of invoices and compliance with relevant tax regulations (including VAT).
11. Service Availability
- We aim for 99.9% uptime but do not guarantee uninterrupted service.
- The Service depends on third-party providers (Twilio, Stripe, WhatsApp/Meta) whose availability is beyond our control.
- We may perform scheduled maintenance with reasonable advance notice.
- We are not liable for any loss of business, revenue, or data resulting from service interruptions.
12. Limitation of Liability
To the maximum extent permitted by law:
- Gaffer is provided "as is" without warranties of any kind, express or implied.
- Our total liability to you for any claim arising from the Service is limited to the fees you paid in the 3 months preceding the claim.
- We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, business, or data.
13. Indemnification
You agree to indemnify and hold Gaffer harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
- You may cancel your account at any time through the billing dashboard or by contacting us.
- We may suspend or terminate your account immediately if you breach these Terms.
- Upon termination, your access to the Service ceases and your phone number is released. You may request an export of your data within 30 days of termination.
- After 30 days, your data will be permanently deleted in accordance with our data retention policy.
15. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
